Purpose 

The Master Commissioner (sometimes “Commissioner”) is appointed by the Calloway Circuit Court to assist in the discharge of its duties including the sale of property to satisfy judgments.  This website (“site”) is intended to provide general sale information and summary information about future and past sales.

 A list of upcoming and past sales (by date) follows sale terms and conditions information.

The Commissioner can not advise or represent a prospective purchaser or successful purchaser. A purchaser is encouraged to contact his or her attorney before the sale regarding the rights and obligations of a purchaser at a judicial sale.

 Sale Terms and Conditions

 At the time of sale, the successful bidder shall either pay full cash or make a deposit of ten percent (10%) of the purchase price with the balance on credit for thirty (30) days. If the purchase price is not paid in full, the successful bidder shall execute a bond at the time of sale with sufficient surety approved by the Master Commissioner at least one day prior to the sale to secure the unpaid balance of the purchase price. The bond shall bear interest at the rate the judgment bears from the date of sale until paid. In the event the successful bidder is the plaintiff, then in lieu of the deposit the plaintiff shall be allowed to bid on credit up to the judgment amount.

 The purchaser shall be responsible for ad valorem taxes due in the year of sale. The property will be sold subject to easements, restrictions and other matters of record; any issue that a survey or inspection of the property may disclose; and if applicable, the right of redemption of the Defendant property owner(s) or the United States of America. The sale may be canceled and any announcements made at the sale take precedence over printed matter contained herein. The successful bidder has 10 days after the Commissioner files a Report of Sale to examine title and file exceptions, if appropriate.

 General Information

  •  Sales.  Sales are typically held on the third Thursday of each month at 10:00 a.m. CST at the Calloway County Courthouse, 101 South 5th street, Murray, Kentucky.  Sales are typically advertised in the Murray Ledger & Times on the first and second Wednesday of each month.  Sale and advertising dates may vary based on the Calloway Circuit Court’s schedule and how the days of the month fall.

  •  No Warranty.  All sales are “AS IS” without warranty of any kind. 

  • Cancellations.  A scheduled sale may be canceled any time prior to the commencement of the sale.

  • Inspection. The Commissioner does not have a key to or access to the inside of any property and does not have authority to grant anyone access to any property.

  • Appraisal and Right of Redemption.  In all sales to pay a debt, the Master Commissioner has the property appraised.  This is a “drive by” appraisal for the purpose of establishing the right of redemption value.  Kentucky law requires that if the property does not bring 2/3rd of the appraised value, the owner has six months from the day of the sale to buy the property back at the sale price plus interest and any reasonable costs incurred by the purchaser after the sale for maintenance and repair, taxes, insurance, etc.  This is called the debtor’s right of redemption.

  • Opening Bids.  Sometimes a foreclosing lender will make an opening bid before the sale. Where an opening bid is made, bids at sale will start at the presale bid.

  • Payment.  At the time of sale, the purchaser has the option of either (1) paying the entire purchase price immediately following the sale or (2) paying at least 10% of the purchase price with the balance to be paid within thirty (30) days.

If the purchaser elects to pay less than the full price, the purchaser must sign a sale bond (on a form provided by the Commissioner) and provide surety at time of sale. The bond shall bear interest on the unpaid balance at the rate the judgment bears, from the date of sale until paid in full, and shall have the force and effect of a judgment.

A “surety” may be a person, bank, or other entity who agrees unconditionally to pay the balance due should the purchaser, for whatever reason, fail to pay in full within thirty (30) days.  A surety must be approved by the Commissioner at least one day prior to the scheduled sale. A proposed surety must furnish the Commissioner a sworn financial statement (on a form supplied by the Commissioner) which shows a net worth of at least 2-1/2 times the sale price.  If a married individual intends to act as surety, the surety’s spouse must also sign. Despite the net worth shown, the Commissioner has the right and discretion to reject any proposed surety for any reason. A typical bank loan commitment will not be sufficient. Only an unconditional Letter of Credit from a bank will suffice.

Should a purchaser (who does not pay the full purchase price) fail to furnish a surety, the Commissioner will report that failure to the court for appropriate action. This may include a resale of the property and a judgment against the original purchaser for any difference in resale value, as well as court costs incurred as a result of the resale.

The Commissioner will only accept personal checks and certified funds/cashier’s checks for payments due the Master Commissioner’s office.  NO CASH WILL BE ACCEPTED. Checks should be made payable to “Master Commissioner, Calloway Circuit Court”.

  •  Exceptions.  Purchasers are encouraged to obtain a title opinion immediately after the sale to confirm that there will not be any liens against the property after the sale. Any objections to the sale must be made within ten (10) days after the filing of the Report of Sale, which is typically filed the day of the sale.

  •  Taxes.  The purchaser pays property taxes for the entire year in which the sale occurs.  There is no proration of taxes.
